Covid-19: Organisation of Intellectual Property Offices

In this context of sanitary crisis and following guidance from governments, Intellectual Property Offices have taken measures in order to maintain protection of Intellectual Property Rights.

France (INPI) All due dates falling between 12 March and 23 June included are extended by one month after the end of this period if the initial deadline was one month (i.e. 23 July) and by two months after the end of this period if the initial period was two months or more (i.e. 23 August).
This extension applies, in particular, to deadlines for trademark oppositions, patent annuity payments, trademark renewals or design extensions and for benefiting from the relevant grace period, filing an administrative or court appeal, submitting third parties’ observations or responding to a notification from the INPI.
On the other hand, this does not affect priority deadlines for international extensions, payment deadlines for patent applications or deadlines for filing a supplementary protection certificate.
EUIPO End of extension period as of 18 May 2020. However, users facing difficulties due to the covid-19 outbreak in meeting deadlines can request extensions in certain circumstances.
WIPO Processing of filed applications remains operational. Remedies available in case of failure to meet time limits due to the pandemic and extension of time limits in case of Office closures.
Suspension of all communication by postal mail until further notice, all PCT-related documents will be transmitted only via e-mail.
EPO All time limits expiring on or after 15 March 2020 are extended until 2 juin 2020.
Afghanistan All operations suspended until 1 June and deadlines to be met during this period will be automatically extended until the TMO reopens for business.
AIPO Suspension of procedural deadlines expiring between 18 March – 31 May 2020 inclusive until 15 July 2020.
Andorra All deadlines for administrative procedures are suspended for a maximum time of 2 months. Prescription and expiration deadlines are suspended. However, procedures that are essential to trademark owners are carried out.
Argentina Suspension of all time limits  until 24 May 2020.
ARIPO (African Organisation) Office remains operational but it is recommended to use online services.
Australia Office remains operational. From 22 April 2020 until at least 31 May 2020, those impacted by COVID-19 can obtain an extension-of-time of up to 3 months free of charge for Patent, Trade Marks and Designs requests.
However, these extensions are not available for renewal/maintenance/continuation fees, although the 6 months grace period is available.
Austria Re-opening of the Office from 18 May 2020.
Belize Online filing system available.
Benelux Suspension of deadlines during the period of public restrictions imposed by the Benelux countries, and thereafter, grant of a month’s grace period.
Brazil Extension of deadlines until 31 May 2020.
Canada Most deadlines that fall between 16 March 2020, and 29 May 2020, are extended until 1 June 2020.
Chile Available via online services.
Columbia Office closed until 31 March 2020. All deadlines falling during this period are postponed to 1 April.
Costa Rica Office remains partially open and accepts application as usual.
Djibouti All operations suspended until further notice and deadlines to be met during this period will be automatically extended until the Office reopens for business.
Dominican Republic Online filing system available.
Ecuador Online filing system available.
Egypt As of 26 May 2020, IP Offices will resume usual activities
Ethiopia Suspension of operations until further notice. All deadlines falling during the shutdown have been extended to 19 July 2020.
Finland Office closed but available via online services. Suspension of deadlines that fall between 16-22 March.
Gaza All operations suspended until further notice and deadlines to be met during this period will be automatically extended until the Office reopens for business
Greece Office closed until further notice. Deadlines are extended until the Office reopens.
Guatemala Re-Opening of the Office. Suspension of legal terms.
Honduras Office closed. Online filing system available. All deadlines are in suspension.
India The new due date for all deadlines falling between 15 March to 17 May 2020 is 1 June 2020. The deadline for all matters falling due between 18 May to 31 May 2020 remains unchanged.
Indonesia Office closed until 29 May 2020. It will resume operations on 1 June 2020.
Iraq As of 27 April, all trademark transactions are available except trademark searches and filing new trademark applications. Patent transactions are not available except cases with deadline.
Ireland Office closed until at least 18 May 2020, the days between 13 March and 18 May are deemed to be “excluded days”.
Italy Suspension of all deadlines with respect to patents, trademarks and designs until 15/04/20.
The titles expiring between 31/01 and 15/04 will remain in force until 15/05/20..
Japan Lifting of the state of emergency as of 21 May 2020.
Jordan All IP transactions will be available normally as of 26 May 2020
Kurdistan All IP activities have been resumed as usual as of 11 May 2020.
Kuwait All operations suspended until 30 May 2020 and all deadlines related to IP prosecution and litigations have been extended as of 12 March to the date on resuming of usual operations of the Office.
Lebanon Suspension of all delays between 18 October 2019 and 30 July 2020
Libya All IP transactions are available without the necessary documents at the time of submission.
Malaysia Four branches of the Office reopens on 8 May.
Deadlines for priority applications have been extended to 10 June 2020, whereas other deadlines have been extended to 16 June 2020.
Moldovia Deadlines for proceedings before the AGEPI are suspended until the lifting of the country’s state of emergency.
Morocco Online services available. Suspension of all Office deadlines until the lifting of the country’s state of emergency, on 10 June (unless extended).
Netherlands Office closed, but available via online services. Patent applicants can request for an extension of time or restoration of rights.
New Zealand Office remains operational. Requests for extension of time may be available for deadlines missed due to the COVID-19 outbreak.
Nicaragua Office remains partially open and accepts application as usual.
Norway Office closed but available via online services. Deadline extensions for “at least two months” granted for designs and trademarks.
Requests for re-establishment of rights may be available for failure to meet a specific deadline or loses registered rights during this period.
Oman All operations suspended until further notice and deadlines to be met during this period will be automatically extended until the Office reopens for business.
Panama Office closed until further notice.
Pakistan The Office will re-open for public dealing with effect from 11 May 2020. All cases in which deadline for filing documents/requests had expired during the lockdown period from 24 March 2020 to 9 May 2020, will be accepted on the opening date as filed within prescribed time. All hearings will stay suspended until further notice. .
Paraguay Online filing system available.
Peru All operations and deadlines are suspended from 16 March 2020 to 24 May 2020 inclusive (State of emergency).
Philippines Office closed until 15 May 2020 but available via online services.
Poland Time limits regarding the proceedings before the Office are suspended.
Deadlines for filing oppositions and for validations, which fall between 8 March to 30 June 2020 are suspended until 1 July 2020.
Portugal Deadlines are no longer suspended.
Qatar Suspension of legal deadlines (and related penalties) from 5 April until further notice. However, this suspension is not applicable “to annuities, examination and grant fees for patents which are paid online”.
Salvador Office closed until further notice.
Saudi Arabia Office is functioning normally via online services. Official Deadlines have been extended until 30 May 2020.
Singapore
Office closed but available via online services. All filing deadlines will be extended to 5 June 2020.
South Africa Re-Opening of the Office.
South Korea Extension of deadlines falling in the period between 30 April – 30 May to 31 May 2020, the deadlines which have already been extended to 30 April 2020 will now be further extended to 31 May 2020.  But, these ex officio extensions are not applicable to the statutory periods prescribed by patent/trademark laws or treaties.
Spain State of emergency and suspension of all deadlines until 24 May.
Syria All operations suspended until further notice and deadlines to be met during this period will be automatically extended until the Office reopens for business.
Switzerland Assessment of requests for extensions of time limits on a case-by-case basis and pursuant to national and international law. Extension of two months of the usual time limits followed by a third extension of an appropriate duration for important reasons.
Taiwan Request for reinstatement may be available for deadlines missed due to the COVID-19 outbreak.
Tunisia IP transactions are available normally as of 4 May.
Turkey All time limits in legal proceedings have been suspended as of 13 March 2020 until 15 June 2020.
United Kingdom Period of interruption until at least 28 May 2020, most deadlines may be extended during such period.
United States Most deadlines occurring from 27 March – 31 May are extended to 1 June.
Venezuela All deadlines postponed until further notice.
Vietnam All procedures for registration of industrial property rights due in the period from 30 March 2020 to 30 April 2020 will be extended to 30 May 2020.
West Bank All operations are suspended until 5 June 2020 and deadlines to be met during this period will be automatically extended until the Office reopens for business
