DiDiDiDiDiDi first sound trademark recognised by a legal decision in China

Tencent filed a sound trademark application for the sound “didididididi” in relation with its instant messaging software, Tencent QQ.

Following a refusal for lack of distinctiveness, both in first instance and on appeal, Tencent filed an appeal with the Beijing Intellectual Property Court that eventually ruled in its favour.

This decision was confirmed by the Beijing’s Higher People Court that recognised the registrability of this sound trademark on the ground that:

  • on the one hand, its specific rhythm and melody allow to identify its source,
  • and, on the other hand, its long-term and extensive use confers a distinctive character on the sound.
