EU designs: What changes on 1 July 2026

The Designs Package enters its second phase. Regulation (EU) 2026/715 of 11 March 2026 repeals Regulation (EC) No 6/2002. It is supplemented by Implementing Regulation (EU) 2026/138 of 15 January 2026 and by EUIPO Executive Director Decision EX-26-3 of 8 June 2026, both applicable from 1 July 2026.

Key changes:

  • Modernised representation: a design may be reproduced in static, dynamic or animated form, by any appropriate technical means. Movements, transitions and animations become fully representable.
  • Formats now set: Decision EX-26-3 lays down the technical specifications. JPEG for static views, up to 10 per design instead of 7. OBJ or STL for dynamic representations. MP4 for animated designs (H.264 codec, 24 to 30 fps, no audio track). Files are capped at 2 MB per JPEG view and 20 MB per dynamic or animated file, within a 1 GB limit per application.
  • More flexible multiple applications: the single-class requirement under the Locarno Classification is removed. A single application may group up to fifty designs across different classes.
  • Deferment of publication: at the end of the deferment period, publication becomes automatic unless the holder expressly renounces it before the deadline. The separate publication fee is abolished.
  • Correction of views: the representation may be amended, but only as to insignificant details, without affecting the scope of protection.
