First sound trademark published by the INPI

As part of the transposition of the “Trademark Package”, the requirement for graphic representation, which was so far necessary to register a trademark, has been removed from Article L711-1 of the Intellectual Property Code.

Accordingly, it is now possible to file new types of trademarks, including: sound, multimedia or motion marks by means of a digital fingerprint.

A first sound trademark was published on 17 January 2020 through a MP3 file which is available on the INPI’s website.

This change in legislation should allow to facilitate the legal protection of communication elements.
