UPC update: Decision on the provisional allocation of patent litigation

As indicated in a press release of May 16th, the Presidium of the Unified Patent Court (UPC) has decided that, as of June 1, 2023, patent litigations pending before the Central Division will be provisionally splitted between Paris and Munich:

  • Paris Division will be responsible for patents classified in section A of the International Patent Classification (IPC), i.e. patents relating to the "human necessities", in particular medical and veterinary sciences as well as pharmaceuticals; and
  • Munich Division will be responsible for patents classified in section C of the IPC, i.e. patents in the field of chemistry and metallurgy.

These reallocations follow the withdrawal of the United Kingdom from the UPC agreement (next to the Brexit), as litigations relating to these patents were initially allocated to London Division.
