New systems for trademark protection in .XXX extension?

[10/12/2021]

As a reminder, this was a blocking system (and not a reservation system) initiated in 2011 which will expire on 14 January 2022.

This system was intended to prevent any third parties from registering your trademarks in an .XXX top level domain (TLD).

It is now possible to subscribe to the new "Adultblock” service which consists of blocking, via a single subscription, the registration of your trademark among the 4 extensions .XXX, .PORN, .ADULT and .SEX.

The « Adultblock +» service is intended to block homoglyphic and typographic variants of the relevant names, and their variants in other languages. The registry provides a service to identify any variants covered by such protection.

Without action on your part, from 14 January 2022, domain names will again be available on a on a first-come, first-served basis.

This could expose you to a risk of "pornsquatting" accentuated by a commercial and pricing policy that may be intentionally aggressive on the part of the registry editing the 4 relevant extensions: .XXX, .PORN, .ADULT et .SEX.

Nevertheless, to date, few domain names are registered under these extensions, of which nearly 75 to 80% redirect to a parking page, which thus limits the visibility of these domains and the potential damage to your rights.

In addition, in the event of an obvious infringement of your rights, an extrajudicial action, such as UDRP / URS, would still be possible.

We will be happy to provide any additional information relative to AdultBlock+ systems which are available for all your trademarks.
