The EUIPO has upheld the non-use cancellation action filed by Supermac against the “Big Mac” trademark held by Mc Donald’s.

In its decision of 11 January 2019, the EUIPO considered that the evidence of use provided by Mc Donald’s was not sufficient to establish genuine use of its trademark for the claimed goods and services, in particular, for services related to restaurants.

This decision highlights the need to retain relevant evidence of use of your trademarks.
