Adoption of a New International Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge

On May 24, 2024, after decades of negotiations, WIPO member states approved a new Treaty related to intellectual property, genetic resources and associated traditional knowledge.

The Treaty establishes that, where an invention claimed in a patent application is based on genetic resources or traditional knowledge associated with genetic resources, the applicant shall, in said patent application:

• disclose the country of origin or source of the genetic resources; and
• mention the Indigenous Peoples or local community who provided the traditional knowledge.
