Amendment to Canada’s Trademark Act

The new trademark regulation will come into force on 17 June 2019 and will allow Canada to join the Madrid Protocol, the Singapore Treaty and the Nice Agreement.

Here are the most significant changes:

– Harmonization of administrative formalities and procedures with the International standards in force;

– Registering a trademark in Canada by filing an International registration;

– Declaration of use no longer required for trademark application;

– Reduction of term of protection from 15 years to 10 years;

– Adoption of Nice Goods and Services Classification System.
