Key step in the fight against fraudulent trademark applications in China

Further to the approval on the revision of the Trademark Law by the Standing Committee of the Congress, new amendments to the Chinese Trademark Law will become effective on 1st November 2019.
Among them, it should be noted, in particular, that:
- any application for the registration of a trademark that is not intended for use shall be rejected at the examination stage by the Chinese PTO,
- trademark agents shall preferably ensure the good faith of their clients before filing their marks.
- anyone shall be able to initiate an opposition against any application filed in bad faith within the opposition period,
These amendments are good news for trademark holders in China who are constantly confronted with trademark squatting.
