First patent opposition decision issued by the INPI

Following the entry into force of the Pacte law, the first opposition decision against a French patent was rendered after oral proceedings.

The opponent requested the revocation of the patent on the ground of lack of novelty and inventive step.

The patent was maintained in an amended form.

The opposition was lodged on 31 December 2020 and the decision was rendered on 23 March 2022, i.e. after approximately 15 months of proceedings.
