Impacts of China’s Accession to the Hague System

As we mentioned in our previous post dated of 8 February, China joined the Hague Systemfor the International Registration of Industrial Designs on 5 February 2022.

China's accession to this treaty will come into force on 05 May 2022  and will allow applicants of international designs :

- to protect their rights in China through a single international application and set of fees.

- to have simplified procedures for renewal, recordal of change of ownership or owner’s name/address

- to benefit from a design patent term extended from 10 years to 15 years

However, some restrictive aspects of the Chinese Patent Law may not be changed, such as the novelty grace period and the strictness regarding design views… among others.
